14-1688. Fraudulent signing of credit cards or sales slips; essential elements.

For you to find the defendant guilty of fraudulently signing a [credit card]1 [sales slip or agreement] [as charged in Count __________]2, the state must prove to your satisfaction beyond a reasonable doubt each of the following elements of the crime:

1.   The defendant signed a [credit card3]1 [sales slip or agreement3] with a name other than defendant’s own name;

2.   The defendant was not authorized to use the credit card;

3.   The defendant intended to deceive or cheat;

4.   This happened in New Mexico on or about the __________ day of ______________, __________.

 

USE NOTES

2.   Insert the count number if more than one count is charged.

3.   If the jury requests a definition of “credit card” or “sales slip or agreement,” the statutory definition set forth in NMSA 1978, Section 30-16-25 is to be given.
